TERMS OF SERVICEGENERALBy commissioning, you are agreeing to these terms.
You are also agreeing that you are over/of the age of 18 and are otherwise of entering into a legal contract.
Failure to read these terms of service does not nullify the terms and you will still be held to the terms of this contract.RELATIONSHIPYou, the commissioner; are commissioning me to complete a service as a freelance artist to create an original work of art.
I have the right to refuse work, for any reason.
I am free to provide my services to others during completion of your service.
I have the right to post and copy my work, even if it is copyright of your character.
You CANNOT remove or crop any signatures/watermarks I place on your art.
Upon completion of this service, you will be granted permissions for personal use. This means you may print, use, upload the artwork for yourself only. You may not make a profit off of my artwork in the form of prints or any other type of merchandise.
You have the right to re-post any commission I have done for you to your galleries as well as edit, crop, add text, and alter the commission as long as you credit me as the artist and do not remove my watermark.
I, the artist; retain all copyrights to my artwork and can use them as I wish.PAYMENTOnly PayPal.
Full payment must be made upfront within 24 hours of an accepted order.
Payment will be taken through invoice or similar business request.,
I, the artist, will confirm the commission price with you before sending the invoice.
Completion of the payment means that you agree with the cost of this service.PAYMENT PLANSI accept payment plans on orders of $500 or more.
Payment plans MUST be requested prior to bids or claims.
If accepted, payment plans may span no more than 1 week per $100 of order. Example $600 is a max of 6 weeks,
Payment plans require a minimum of 25% to be provided at the time of order/purchase.
If you for any reason are unable to complete the payment and notify me at least 48 hours BEFORE the deadline, you can be refunded your initial deposit minus PayPal fees. Otherwise, you will FORFEIT your deposit. This means ghosting me, not responding to updates, etc.COMMISSIONSWhen you purchase a commission, they are added to my public to do list here: https://dizzybirdyart.carrd.co/#queue
Commissions are completed in order of purchase with orders in RUSH queue going before General Queue.
General turnaround time is 7-14 days per page once the project enters the "In Progress" stage.
If your order is not finished due to client not responding, the order will be moved to "On Hold" status. I will make many attempts to help you resolve the On Hold. If I feel the project stayed in On Hold for too long, I will abandon the project. Abandoned projects will get no refunds and I will use the art however I wish including using it for YCHs and adoptables. You will have to start the entire process over again if you decide you want another commission even if its the same one you'd abandoned.
Commissions are non-refundable after the page's sketch WIP has been approved.
Commissioners are limited to 2 pages per order, regulars and Patreon/Ko-fi subs are allowed 6 pages.TRADES & REQUESTS
Trades and Requests are taken anytime if I am interested in them.,
Accepted trades will be discussed in detail for characters, content, style, etc. upon acceptance.
There are no set deadlines for my trades or requests, we each agree to keep in communication with the other regarding delays, queue, etc.
We each will confirm all details to ensure no misunderstandings on the expectations for each party regarding quality, time frame, etc.
You nor I shall deliver the full completed file to the other until BOTH parties have completed the work.REVISIONSYou will be given 1 WIP (Work in progress) after the general sketch is completed. No additional WIP's will not be provided unless you make a specific request for them.
Only 2 additional WIP's will be provided for free, any WIP's after that will be an added service fee of $5 per WIP, paid for before the WIP is provided.
Corrections for mistakes on items visible on the reference, will be corrected free of charge.
Corrections based on new information, will cost more or be rejected. A revision fee will apply, should the correction be accepted. Based on the complexity the fee is 20% - 80% per change.REFUNDS/CANCELLATIONSIf have not started you will be refunded in full.
I require 1 week to process small refunds, which are issued in order of request.
If work has been sketched but no WIP sketch has been sent, you will be refunded 50% minus PayPal fees. Cancelations cannot be requested once the WIP sketch has been sent.
The artwork is non-refundable once completed.MISCELLANEOUS FEESWritten Description Fee: Character will be mocked up in a messy sketch so I have a reference for the commission. 50% of total commission price.
Rush Order Fee: 50% of original price.
Cancelation Fee: 50% of total price.CONFIDENTIALITYYou and I both agree that we will not knowingly share any private information gained during and after use of my services. The exception to this is any disclosure required to complete the service. Private information includes but is not limited to: Names, Email Addresses, Physical Addresses, Dates of Birth, or other information that could reasonably be deemed personally identifiable. As well as account information, including but not limited PayPal, Bank Accounts, or otherwise.GRANT OF RIGHTS
Once the final artwork is completed, I will grant you a NON-COMMERCIAL license to: upload to your gallery(ies) and other sharing platforms with reference to the artist.
You DO NOT have the right to use this artwork for personal gain, financial opportunity or otherwise. This includes but is not limited to selling my art as a print, shirt, sticker, button, or other commercial venues.
In the case of adopts you DO NOT have the right to use this character or artwork for personal gain, financial opportunity or otherwise on a commercial level. This means offering the character up for YCH'S, using them in your own personal merch is allowed, however you may not sell the character.
In the event of a refund partial or otherwise, you are giving up your rights to any works already started or any characters purchased. You may not use/upload any of the artwork/wips unless the commission is completed in full.
You agree that a chargeback or reversal of payment will constitute a breach of these terms and this grant of rights will be revoked immediately regardless of how the dispute pans out. This means any art or characters obtained you will no longer hold the rights too. If the artwork has not been completed it will be stripped and sold off as a YCH, if this was a purchase of an adopt the character will be resold and any artists who may have done artwork of the character will be notified of the situation and provided the name of the new owner.
Again this is all regardless of how the dispute pans out if you win, lose, or cancel the dispute the chargeback terms are final and unchanging.This TOS is subject to be updated regularly so please be sure to check back before each new commission.
